Mediation is a powerful tool for tackling workplace/work environment disputes of all kinds, particularly where privacy is preferred, and the parties need a viable continuing relationship.
Mediation is a proven interest-based process that allows people in dispute to resolve their conflict themselves, making for better outcomes, saving time and money, and avoiding the significant direct costs associated with stress-related absences, job vacancies, productivity losses, declining morale, etc.
This session will teach participants about the interest based mediation theory and practical techniques for eliciting interests and breaking through poor or no communication in the workplace by keeping the dialogue going. Participants will participate in a practice session where they can work through a fictionalized workplace dispute in mock mediation format.
Learning Objectives:
By attending this session, participants will learn:
- Reinforcement of interest based conflict resolution principles
- Real world techniques for resolving conflict yourselves, without the assistance of a mediator
- Reinforcement of cases when it is appropriate to call in a third party, i.e. mediator
- Reinforcement of cases when mediation is not the appropriate resolution tool
- Hands-on role playing in mock mediations
About the Speaker:
Jim Musgrave, Q.C, Cox and Palmer
With more than 20 years' settlement experience as a practicing lawyer in Halifax, Jim is also a certified mediator with experience resolving workplace disputes. Jim offers "Resolution Without Regret" interest-based dispute resolution. Simply put, Jim helps people and organizations resolve their conflicts themselves, making for better outcomes, saving time, money, and relationships, and avoiding the risk and cost of litigation.
Jim is an approved mediator with the Nova Scotia Public Service Commission Respectful Workplace program, a frequent lecturer on mediation at the NS Bar Admission Skills Course, a trainer and writer on mediation principles and skills for a variety of professional and other audiences, and a HRANS member.
