Terminations from Start to Finish
This session will cover a number of issues that arise during terminations including the benefit of defining the terms of termination in a written employment contract before the employment relationship starts, how to navigate through the challenges that the terminations of various types of employees present (the poor performer, the dishonest employee, and the disabled (and allegedly) disabled employee.
It will also cover navigating through the challenges that legislative tenure provisions present and assist in answering the following questions and topics:
- Reasonable Notice - how much is reasonable?
- Working notice, and pay in lieu of notice, or a combination?
- What is bad faith in the manner of termination?
- Negotiating the severance package.
- Obligation to mitigate.
About the Facilitator
Rick Dunlop, Partner, Stewart McKelvey
Rick Dunlop is a Partner with Stewart McKelvey's Nova Scotia Labour and Employment Group. Rick has a diverse management side labour and employment law practice in which he provides practical solutions and representation on all workplace legal issues. In particular, Rick often represents employers in human rights complaints, union certification applications in the construction and non-construction industry sectors, and wrongful dismissal actions.
Rick regularly appears before all Nova Scotia courts and labour and related tribunals including the Nova Scotia Labour Board, Supreme Court of Nova Scotia, and the Nova Scotia Court of Appeal. Rick has also successfully represented an employer before the Supreme Court of Canada in an employment law case.
Rick consistently speaks and writes on labour and employment law related matters. Rick has been externally rated as Best Lawyers: Labour and Employment Law in 2013, 2014, 2015 and 2016. Rick is a current member of the Canadian Association of Counsel for Employers (CACE).

The registration deadline is Tuesday, March 14, 2017, at 12:00 pm (or earlier if the event is sold out). Please note that registrations are not possible after online registration has closed. Registration cannot be purchased at the door.
Payment is due by the registration deadline (March 14 or within 30 days of your registration (whichever is earlier). Payments may be made conveniently online at time of registration by Visa/Mastercard or by cheque received by the registration deadline. Cheques must be received by the registration deadline (March 14) by HRANS at 84 Chain Lake Drive, Suite 103, Halifax, NS B3S 1A2. Registrations February 15th or later must be paid online at time of registration.
If paying online by Visa or Mastercard, you must have the billing address exactly as it appears on the credit card statement or the transaction will be declined. This is a security feature for your protection.
A refund, less a $40+HST processing fee, will be issued for cancellations received in writing prior to February 15, 2017 at 12:00noon. Those who make reservations and do not attend will be required to pay for the full session fee. Cancellations received in writing prior to 12:00 noon on February 15, 2017 will only be charged the processing fee. Substitutions are permitted up to the business day before the event (for substitutions, the registrant must advise our office of their replacement in writing by 10:00am on March 22). Member/non-member rates will be applied to the substitutions. This cancellation policy applies regardless of date of registration. Registrations after the cancellation deadline are non-refundable.
